THIS CONTEST IS ONLY OPEN TO LEGAL RESIDENTS OF CANADA (EXCLUDING QUEBEC, THE NORTHWEST TERRITORIES, YUKON AND NUNAVUT) AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO THE LAWS OF CANADA AND THE APPLICABLE PROVINCE. VOID ELSEWHERE AND WHERE PROHIBITED BY LAW.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
The sponsor of the Contest is Weston Foods (Canada) Inc. (the “Sponsor”). The Contest is in no way sponsored, endorsed, or administered by Rogers Blue Jays Baseball Partnership (“RBJBP”). RBJBP is not a legally liable sponsor of this Contest; RBJBP is a prize supplier only. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to RBJBP.2. CONTEST PERIOD:
The Eligible Product (defined below) obtention period begins on May 12, 2016, and ends on September 1, 2016 or once all Eligible Products have been claimed, whichever occurs first (the "Obtention Period"). The Prize (defined below) claim period begins on May 12, 2016, and ends on October 1, 2016 or once all Prizes have been claimed, whichever occurs first (the “Claim Period”). It is estimated that 6.5 million Eligible Products will be distributed in the course of the Obtention Period; however, the actual number of Eligible Products available for distribution may vary as a function of Eligible Product manufacturing and supply. The number of Eligible Products available for distribution will decrease as they are claimed in accordance with these Official Rules and Regulations (the “Rules”) throughout the Obtention Period.3. ELIGIBILITY:
To enter and be eligible to win, you must be a legal resident of British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, New Brunswick, Prince Edward Island, Nova Scotia or Newfoundland and Labrador and have reached the legal age of majority in your province of residence at the time of entry. Despite the foregoing, employees, representatives or agents (and those with whom such persons are living, whether related or not) of the Sponsor, its parent organization, subsidiaries, affiliates, prize suppliers, advertising/Contest agencies and any other entity involved in the development, production, administration, or fulfillment of the Contest (collectively, the “Contest Parties”) are ineligible to enter or win.4. HOW TO OBTAIN AN ELIGIBLE PRODUCT:
NO PURCHASE NECESSARY. There are two (2) ways to obtain an Eligible Product during the Obtention Period, while supplies last:
Eligible Purchase: You may purchase a specially-marked Wonder “Find the Bun, Win Summer Fun” bakery product (eligible SKUs: Wonder White 8pk Hamburger Buns ; Wonder White 8pk Hotdog Buns ; Wonder White 12pk Hamburger Buns ; Wonder White 12pk Hotdog Buns ; each, an “Eligible Product”) at a participating retail location during the Obtention Period (while supplies last) (collectively, an “Eligible Purchase”). The exact date Eligible Products will be available at any given participating retail location may vary based on distribution. There is a limit of one (1) Eligible Purchase per person per day (with reference to Eastern Time) for the purposes of this Contest.
No Purchase Necessary Requests: To obtain an Eligible Product (while supplies last) without having to make an Eligible Purchase, write to: FIND THE BUN. WIN SUMMER FUN CONTEST, 544 KING STREET WEST, TORONTO, ON M5V1M3; and include: a) a 50-word (or more) handwritten original essay on “Why you love Wonder bread products?”; and b) your first name, last name, full mailing address (including city, province and postal code), date of birth and email address (collectively, a “No Purchase Necessary Request”). In order to be eligible, your No Purchase Necessary Request must be postmarked and received during the Obtention Period. Limit of one (1) No Purchase Necessary Request per person per day (with reference to Eastern Time). There is a limit of one (1) No Purchase Necessary Request per envelope with sufficient postage. No mechanical reproductions of No Purchase Necessary Requests will be permitted. If you submit an No Purchase Necessary Request in accordance with these Rules (as determined by the Sponsor in its sole and absolute discretion), you will be eligible to receive a reply letter (that will be sent to the mailing address provided in your No Purchase Necessary Request) (each, a “Reply Letter”) that includes one (1) coupon that can be redeemed for a free Eligible Product during the Obtention Period (while supplies last) (each, a “Coupon”).
At the beginning of the Claim Period, there will be a total of twelve (12) prizes (each, a “Prize”) available to be won. The number of Prizes available to be won will decrease throughout Claim Period as they are claimed. Each Prize consists of:
The total approximate retail value of each Prize is $5,000 CAD. Confirmed Prize winners should allow approximately 3-4 weeks for delivery of their Prize. Each Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion). No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize (or any part thereof) with a prize of equal or greater retail value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. The characteristics and features of the Prizes (except as otherwise explicitly stated above) are at the Sponsor’s sole and absolute discretion. All costs not expressly stated above as included in a Prize are the applicable winner’s sole responsibility.6. PRIZE WINNER NOTIFICATION:
The Sponsor will randomly select twelve (12) Eligible Products and will include one (1) bun that is branded with a Contest Wonder “W” logo (each, a “Winning Bun”) in each such randomly selected Eligible Product. If you have obtained an Eligible Product in accordance with these Rules, open the packaging and inspect the buns included therein – if one (1) of the buns is a Winning Bun, you will be deemed a potential Prize winner (subject to fully complying with these Rules, as determined by the Sponsor in its sole and absolute discretion). Limit one (1) Prize per Winning Bun. Odds of finding a Winning Bun in an Eligible Product are approximately 1 in 541,666.7. PRIZE CLAIM AND WINNER CONFIRMATION PROCEDURE:
In order to claim a Prize, each potential Prize winner will be required to contact the Sponsor during the Claim Period via telephone (1-888-494- 6244) and will be required to follow the Sponsor’s Prize claim instructions within the timeline specified by the Sponsor (failing which, such potential winner may be disqualified, as determined by the Sponsor in its sole and absolute discretion). Without limiting the generality of the foregoing, as part of a Prize claim, the Sponsor may require a potential Prize winner to provide (among other things): i) the winning Eligible Product packaging (the “Eligible Product Packaging”) and kwik lok bag closure (the “Kwik Lok”); and ii) a photograph (or separate photographs) of the Eligible Product Packaging, Kwik Lok and Winning Bun (a “Claim Photo”). Each potential Prize winner is solely responsible for keeping the Claim Photo, Eligible Product Packaging and Kwik Lok until the Prize claim procedure and winner confirmation procedure (see below) are completed (as determined by the Sponsor in its sole and absolute discretion).
BEFORE BEING CONFIRMED AS A WINNER OF A PRIZE, each potential winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may be administered by telephone, online or via the Sponsor’s declaration and release, as determined by the Sponsor in its sole and absolute discretion); (b) sign and return the Sponsor’s declaration and release (within seven (7) days of notification), which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of a Prize as awarded; (iii) releases the Contest Parties, RBJBP, and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding, use or misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph (including without limitation providing the Sponsor with a photograph of the winner with his/her Prize and/or Winning Bun, as determined by the Sponsor in its sole and absolute discretion) or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor worldwide, in perpetuity and in any type of media, including print, broadcast or the internet. If a potential Prize winner: (a) fails to correctly answer the skill-testing question; (b) fails to complete the Prize claim procedure or return the properly executed Sponsor’s declaration and release within the specified time; and/or (c) cannot accept the Prize as awarded (for any reason); then he/she will be disqualified (and will forfeit all rights to a Prize) and such Prize will not be awarded.8. LIMITS:
If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; (iii) falsely submit any Contest-Related Materials (defined below) without having obtained such Contest-Related Materials in this Contest in accordance with these Rules; and/or (iv) submit any Contest-Related Materials that have been falsified, manipulated or otherwise altered in any way; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. The Released Parties, are not responsible for late, lost, misdirected, delayed, incomplete, illegible or incompatible Contest-Related Materials (all of which are void).9. VERIFICATION:
All Eligible Purchases, Reply Letters, Coupons, Photos, Eligible Product Packaging, Kwik Loks and No Purchase Requests (collectively, “Contest-Related Materials”) and entrants are subject to verification at any time and for any reason. Without limiting the generality of the foregoing, the Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity, eligibility and/or compliance with these Rules (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Contest-Related Materials or other information entered (or purportedly entered) for the purposes of this Contest; (iii) for verifying the eligibility of an Eligible Purchase or Coupon redemption (including without limitation proof of an Eligible Purchase or Coupon redemption, such as the original Kwik Lok and/or other form of proof of Eligible Purchase or Coupon redemption that includes the date, time and participating retail location of the Eligible Purchase or Coupon redemption); and/or (iv) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification (as determined by the Sponsor in its sole and absolute discretion). The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).
IMPORTANT NOTE: Without limiting the generality of the foregoing and for greater certainty, each entrant is solely responsible for retaining his/her original Contest-Related Materials (including, without limitation, Coupons, Eligible Product Packaging, Kwik Loks and Reply Letters, as applicable) for verification purposes. Any Contest-Related Materials that cannot be verified to the complete satisfaction of the Sponsor as compliant with these Rules within the timeline specified by the Sponsor, in its sole and absolute discretion, are subject to immediate disqualification (in which case any rights to any Prize associated with such Contest-Related Materials will be void and forfeited in their entirety).10. GENERAL CONDITIONS:
This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Contest-Related Materials and/or entrants. By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
The Released Parties will not be liable for: (i) any failure of any website during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Contest-Related Materials or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (vi) any combination of the above.
In the event of a dispute regarding who obtained an Eligible Product, the Sponsor reserves the right, in its sole and absolute discretion, to deem that an Eligible Product was obtained by the individual that retains the Kwik Lok associated with such Eligible Product. An entrant may be required to provide (upon Sponsor’s request and within the timeline specified by the Sponsor) the Kwik Lok associated with the Eligible Product in question.
The Sponsor reserves the right, at its sole and absolute discretion, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud, error or failure of any kind whatsoever. Any attempt to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.
The Sponsor reserves the right, at its sole and absolute discretion, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Contest-Related Materials with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any other Contest-related materials, including, but not limited to: the Contest-Related Materials, any website, Eligible Product packaging, and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.
The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
